Frequently Asked Questions (FAQs)

General Questions
1. What services do you provide?
We offer an online platform where couples can create and customize a marriage contract (often called a “prenup”) by answering guided questions. Our platform simplifies the drafting process by providing templates and explanatory resources. However, we are not a law firm and do not provide legal advice.
2. Are you lawyers or do you employ lawyers?
No. We are not a law firm, and we do not employ lawyers to give legal advice. Our role is to provide a user-friendly, technology-based platform that allows you to generate a customized marriage contract. If you need legal advice or have specific legal questions, we strongly recommend consulting a qualified lawyer.
3. Is the contract generated by your platform legally binding?
A properly drafted and executed marriage contract can be legally binding in Ontario (and in other provinces or territories), provided it meets certain criteria. For instance, both parties generally need to:
- Have the capacity to contract (i.e., understand what they are signing).
- Disclose their financial information accurately.
- Sign the contract voluntarily and without pressure or coercion.
That said, enforceability ultimately depends on your specific circumstances and whether you’ve met all legal requirements. We encourage you to seek independent legal advice to ensure your contract complies with the law and accurately reflects your interests.
4. Do I still need to hire a lawyer if I use your service?
Yes, it’s highly recommended. While our platform provides a convenient starting point, a lawyer can offer independent legal advice tailored to your situation and confirm that your marriage contract meets all legal requirements. If you choose to proceed without legal representation, you assume the risk that your contract may later be challenged or deemed unenforceable.
5. How do I sign and finalize the marriage contract?
Once you’ve generated your contract:
- Print the document.
- Sign the contract in the presence of a witness.
- Have your witness sign as well.
Ontario law typically requires that both parties sign in front of a witness who also signs. Be sure to check the specific legal requirements in your jurisdiction, and consider having a lawyer or notary oversee the signing for added assurance.
6. Do you store or share my personal information?
We take privacy and data security seriously. Any personal data you enter into our platform is protected according to applicable privacy laws. We do not sell or share your personal information with third parties without your consent, except as needed to provide our services or comply with legal obligations.
7. Can I make changes to the contract after I complete it?
Yes. Many couples choose to revisit or update their marriage contract if their financial situation or relationship circumstances change (for example, after having children, receiving a significant inheritance, or changing jobs). You can typically return to our platform to revise your answers and generate an updated draft. However, any changes should be re-signed and witnessed properly to maintain legal validity.
8. What if my partner and I disagree on certain terms?
If you have disagreements, you can still use our service to explore potential terms. However, we do not provide mediation or negotiation services. If you encounter significant disagreements, you may want to consult a lawyer or a professional mediator to help resolve these issues before finalizing a contract. 9. Will my marriage contract apply if we move to another province or country?
Marriage laws vary by jurisdiction. While Canadian provinces and territories often have similar legal frameworks, the rules can differ significantly from place to place—and even more so if you move outside of Canada. If you plan to move, we recommend consulting with a local lawyer to determine whether your contract remains valid or needs updating.
10. Do you offer refunds if I change my mind?
Refund policies depend on the terms and conditions you agree to when you sign up for our service. Generally, because our system provides a customized document, no refunds are issued once the contract is generated.
11. What if I need help or have technical issues while creating my contract?
We offer customer support (via email) for technical questions about using our platform. However, we do not provide legal advice or guidance on specific legal questions. If you require legal clarification, please consult a qualified lawyer in your jurisdiction.
12. Are there any special requirements for couples in common-law relationships?
Yes. Common-law relationships are subject to different rules than legally married couples. Our platform offers templates that can help common-law partners create a cohabitation agreement, which functions similarly to a marriage contract. However, because common-law rights vary by province, we strongly recommend seeking legal advice to ensure the contract meets your specific needs.
